Terms of Service

These Terms govern your use of www.water-temperature-forecast.com (the "Service"), operated by Advanced Field Technologies, Oregon, USA ("we," "us"). By creating an account or subscribing, you agree to these Terms.

1. The Service

The Service provides real-time water-temperature monitoring, 7-day forecast modeling, downloadable historical data, and email alerts for stream and river gages across the US and Canada. Data is sourced from public agencies (USGS, state water resources departments, NOAA NWS), processed through statistical models, and redistributed for informational purposes.

No warranty on forecasts. The Service produces statistical forecasts that may be inaccurate. Do not rely on forecasts for safety-critical decisions (recreation, flood response, fish-kill mitigation, regulatory compliance). Always cross-check with official agency sources.

2. Accounts

You must provide a valid email and a password of at least 6 characters. You are responsible for keeping your credentials confidential. Notify us at info@advancedfield.tech of any unauthorized use.

3. Subscription Plans & Billing

We offer the following subscription tiers, billed monthly in USD via Stripe:

Free Explorer — $0 — 5 downloads/day, 30-day history, 10 stations
Site Pack — $4.99/mo — 25 stations of your choice, 1-year history, alerts
Watershed — $9.99/mo — full HUC8 watersheds, API access, bulk download
State — $14.99/mo — full state coverage, API access, bulk download
All Access — $29.99/mo — every station, custom models, priority support

Subscriptions auto-renew on the same day each month until cancelled. You may cancel at any time from the User Portal; the cancellation takes effect at the end of the current billing period and you retain paid-tier access until then. We do not issue refunds for partial months unless required by law.

Prices and features may change with 30 days' notice to active subscribers. Existing subscriptions are honored at their current price through the end of the term in which the change is announced.

4. Taxes

Prices are listed in USD and exclusive of tax. Customers in jurisdictions that tax SaaS will be charged applicable tax once collection becomes legally required, as determined by our nexus status in your state. You are responsible for providing accurate billing-address information.

5. Acceptable Use

You agree not to:

Scrape, mirror, or republish the Service's data in bulk without a paid plan that includes API access.
Attempt to bypass plan limits, rate limits, or authentication.
Use the Service to send spam, malware, or unlawful content.
Resell access to your account.
Reverse-engineer, decompile, or attempt to extract source code.

API access (where included in your plan) is rate-limited; sustained abuse may result in suspension.

6. Intellectual Property

Source data is owned by the originating public agencies (USGS, NOAA, state agencies) and is in the public domain. Our forecast models, software, brand, and presentation are owned by us. You receive a non-exclusive, non-transferable license to use the Service while your subscription is active.

7. Disclaimer of Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF FORECASTS. Use of the Service is at your own risk.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES.

9. Termination

We may suspend or terminate your account for material breach of these Terms, fraud, or abuse. You may terminate your account at any time. Upon termination, your right to access the Service ceases immediately, and we will delete your personal data within 30 days (subject to retention obligations described in our Privacy Policy).

10. Governing Law

These Terms are governed by the laws of the State of Oregon, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Wasco County, Oregon, and you consent to that exclusive jurisdiction.

11. Changes

We may update these Terms from time to time. Material changes will be announced by email to active subscribers at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
